ICC, okay sa pagbubukas ng mga gamit ni FPRRD

Pinagbigyan ng International Criminal Court (ICC) ang hiling ng mga prosecutor na mabigyan ng access sa ilang materyales na nasa kustodiya ng Registry, kaugnay ng kasong crimes against humanity laban kay dating Pangulong Rodrigo Duterte.
Sa inilabas na redacted decision na isinapubliko, “partly granted” umano ng ICC ang naunang hiniling ng prosecution team, kung saan dalawang materyales ang pinayagang masuri.
“The Chamber therefore finds that there are reasonable grounds to believe that the examination of these materials would produce evidence that is necessary for the investigation,” saad sa desisyon.
“The Chamber therefore finds that such examination is necessary and proportionate to the legitimate investigative needs. Accordingly, the Chamber grants the requested access to [REDACTED] and [REDACTED],” dagdag pa nito.
Gayunman, ibinasura ng ICC ang kahilingan ng prosekusyon na mabigyan ng access sa “keys” na nakuha ng Registry matapos arestuhin at ilipat si Duterte sa kustodiya ng korte.
“Turning to the Keys, the Chamber notes that the Prosecution merely submits that the Keys ‘[REDACTED]’, and does not specify to what items the Keys relate to, nor how such items may provide evidnce that are necessary for the investigation,” saad nito.
Isinaalang-alang dinumano ng korte ang argumento ng depensa na posibleng may kaugnayan ang mga ito sa personal na ari-arian o impormasyon ng mga kaanak ni Duterte, na maaaring lumabag sa kanilang karapatan sa privacy.
Samantala, matatandaan na nauna nang itinakda ng International Criminal Court Trial Chamber III ang pagbasa ng mga sakdal laban kay Duterte sa pagsisimula ng paglilitis sa Nobyembre 30.
